Garnishment. Defendant Becker, now deceased, owed money on contract to plaintiff Markman. Thorp Finance Corporation was indebted
to Becker upon another contract and Markman commenced an action in garnishment against Becker as principal defendant and Thorp
Finance Corporation as garnishee defendant. While this action was pending Becker died. Upon a stipulation of facts the parties
have agreed that the only question is one of law for the court whether the garnishment action survived the death of Becker
so that the plaintiff is entitled to the funds caught in the garnishment action or whether those funds passed into Becker's
estate upon his death free from the claim of garnishment. A like action arises by reason of a debt on contract owed by Becker to plaintiff Castle Chemical Company in which Castle
Chemical Company began a garnishment action against Becker as principal defendant and Thorp Finance Corporation as garnishee
defendant.
